1. Agreement to Terms
By accessing or using Automation DCT ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Service Description
Automation DCT provides an AI-powered automation platform for businesses. We build, host, and maintain automated digital workers tailored to your business needs. Services include AI lead capture, client management automation, workflow orchestration, and custom web application generation. The Service is provided on a subscription basis as outlined in your service agreement.
3. Account Registration
To access certain features, you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit any malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to any part of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated means to scrape or extract data from the Service
- Interfere with or disrupt the integrity or performance of the Service
- Impersonate any person or entity
5. Payment Terms
Payment is required as specified in your service agreement. All fees are quoted in the currency indicated at checkout and are non-refundable except as required by law or as explicitly stated in your agreement. We reserve the right to change pricing with 30 days' written notice. Failure to pay may result in suspension or termination of your account. Payment processing is handled securely through Stripe.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Automation DCT and are protected by international copyright, trademark, and other intellectual property laws. Content you create or upload through the Service remains your property. By using the Service, you grant us a limited license to host, display, and process your content solely for the purpose of providing the Service.
7. Data Ownership
You retain full ownership of all data you submit to the Service, including business data, lead information, and customization content. We do not claim ownership over your data. Upon account termination, you may request an export of your data within 30 days. Our handling of your data is governed by our Privacy Policy.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including third-party service outages, natural disasters, or network failures.
9. Limitation of Liability
To the maximum extent permitted by law, Automation DCT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Termination
We may terminate or suspend your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
13. Anti-Spam Compliance (CASL)
We comply with Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23). By using the Service, you acknowledge the following:
- Commercial electronic messages (email, SMS) are sent only with your express or implied consent as defined by CASL.
- All messages include sender identification, our contact information, and a functional unsubscribe mechanism.
- Consent records (timestamp, method, and scope) are maintained for the duration of the business relationship plus two years.
- Implied consent expires 24 months after the last business interaction, as stipulated by CASL.
- You may withdraw consent at any time by replying STOP to any SMS, clicking unsubscribe in any email, or contacting us directly.
If you use the Service to send commercial messages on behalf of your business, you are responsible for ensuring your own CASL compliance, including obtaining proper consent from your recipients.
